We reserve the right to refuse service to anyone for any reason at any time.

To place an order with us, you must create an account by registering on our website. To register, you must provide your full name, a current and valid email address, a delivery address, and your payment details.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

ELIGIBILITY

YOUR PERSONAL DATA

Your security is paramount to us. We use a reputable third party to process all payments ‘Stripe Europe Ltd’ (Data Protection Ref: 13901/A), and you agree that we can store your information with this party. You also acknowledge that we will not be held responsible for any third party security breaches.

REGISTRATION

You are required to create an account in order to purchase from our Site.

SUBSCRIBING

By subscribing you agree to pay your subscription fee for the goods that are delivered for the term agreed by both parties.

BILLING AND PAYMENTS

Payment for our services and/or goods must be made in full before delivery. Your payment will be processed on the same day of the month you initially signed up unless otherwise specified. For instance, if you sign up on the 15th, you will be charged on the 15th of each subsequent month. Additionally, for specific subscription types, such as the bi-monthly option, you will be charged every other month.

By enrolling in our 3-month or 6-month recurring subscription plans, you commit to receiving a minimum of 3 or 6 boxes, respectively. These charges will occur on a monthly basis, with renewals happening every 3 or 6 months in corresponding blocks. These subscription plans are offered at a discounted rate to acknowledge your commitment. We also offer alternative subscription choices, such as monthly or bi-monthly, providing greater flexibility without long-term commitments.

For your convenience and to ensure uninterrupted subscription benefits, if your payment method expires or has insufficient funds, and you do not update your credit card information while maintaining an ongoing subscription, you grant us permission to continue billing the card on file, even extending the expiration date, until you or the credit card company notifies us of its invalidity. We strongly advise you to regularly update your payment information and ensure sufficient funds are available prior to your renewal date, or alternatively, cancel your membership if you wish to discontinue your monthly subscription. Please be aware that multiple payment failures may result in the cancellation of your subscription.

We reserve the right to change the price of your subscription with prior written notice. Any changes in subscription prices will be communicated to you via email or other suitable means of communication. By continuing your subscription after the notification of a price change, you accept the updated subscription fee.

ORDER AMENDMENTS

We understand that there may be instances when you need to make changes to your order, whether it’s updating your address or adjusting your preferences. To facilitate this, we provide a 30-minute window for order amendments, beginning from the moment you place your order or after your subscription renews. While we make every effort to accommodate these changes, please bear in mind that our primary focus is the efficient packing and shipping of your order. Consequently, there may be situations where we are unable to implement requested changes within this 30-minute timeframe.

It’s crucial to note that we cannot assume responsibility for parcels shipped to incorrect addresses or for sizing preferences that have been altered after your renewal is processed, should you fail to contact us within our 30-minute amendment window. Once an order or renewal is processed, the information provided on the order regarding the address and preferences will determine where the shipment is sent and the sizes included in your order. We cannot be held responsible for changes made after this point.

For any order amendments, please promptly contact us via email at contact@forelockandfringe.co.uk, and we will make every effort to assist you. Your satisfaction is our priority, and we will endeavor to find the most suitable solution for your requirements.

PREFERENCE QUESTIONS

Although we will always make our best effort to tailor your box to suit your preferences, please understand that these preferences cannot always be fully accommodated with each item. For instance, if your horse wears Extra Full, not all brands may offer this size, and we may need to substitute it with size Full.

While we strive to accommodate your colour preferences to the best of our ability, we cannot guarantee fulfilment due to variations in stock received from suppliers. This includes uncertainties regarding available colours and quantities in each size. Certain colours may be less commonly available, resulting in limitations in meeting specific colour preferences. Please note that colour preferences are considered for clothing items only.

We highly value your input regarding preferences, as this helps our team with packing to ensure your satisfaction. However, please be aware that while we endeavor to accommodate your preferences, we cannot guarantee that your preferred choices will always be available. Our ability to fulfill specific preferences is subject to the constraints of our inventory and supplier availability. While we will strive to meet your preferences, we appreciate your understanding in cases where we may need to provide alternative options. Please understand that while we will try our best, these preferences may not always be fully catered for. Your understanding and cooperation are greatly appreciated.

ALLERGIES

Please be advised that we cannot be held responsible for any allergic reactions that may occur due to the use of products contained within our boxes. Each product included in our boxes is accompanied by a comprehensive ingredients list. It is your responsibility to thoroughly review these ingredient lists before using the products. If you have any questions or concerns regarding the ingredients of any product, we recommend that you reach out directly to the manufacturer or brand for clarification. Your safety and well-being are important to us, and we encourage you to make informed choices when using our products.

FAULTY GOODS POLICY

Our returns and faulty goods policy requires customers to report any issues with received items within 30 days of delivery for eligibility for an exchange, following the 30-day period, we cannot replace. In the event of a faulty item, customers must provide photos for our team’s assessment which will be assesed on a case-by-case basis, and we may seek a second opinion from the manufacturer who may request the item for inspection. If confirmed as faulty, we will issue a pre-paid label for return and aim to exchange the item. However, if damage is attributed to general wear and tear, no replacement will be offered, and the item will be returned to the customer. Return shipping costs for faulty items are covered, but customers are responsible for such costs in wear-and-tear situations. Our commitment is to address faults promptly and transparently, ensuring customer satisfaction wherever possible.

PARCELS RETURNED TO SENDER

Please be aware that if you do not collect your order from the Royal Mail or other delivery depot within the specified time frame or if it cannot be delivered due to address-related issues or other factors preventing a successful delivery, the parcels may be returned to us. In such cases, we want to emphasise that we are not responsible for re-shipping these orders or proactively reaching out to you regarding the return. It becomes your responsibility to contact us if you suspect that your parcel may have been returned to the sender.

All parcels that are returned to us are securely stored for a period of 3 months. We will gladly re-send them to you once you have initiated contact with us. Depending on the reason for the return as determined by Royal Mail, you may also be liable for the standard return postage costs, which are set at £3.30 for deliveries to UK addresses (Any parcels shipped outside of the UK are subject to standard shipping rates). Please feel free to get in touch with us should you have any concerns or need further assistance regarding a returned parcel. Your prompt communication ensures a smooth resolution in such situations.

CANCELLATIONS

Members have the flexibility to cancel their Forelock and Fringe subscription at any time through the ‘My Account’ section on our website. This can be easily accomplished by clicking a designated button in your account settings. The cancellation will take effect immediately if done prior to your subscription renewal date. However, if you cancel your subscription after the renewal payment has been processed, the cancellation will be effective starting from the following month.

To ensure a smooth cancellation process, we require a notice of at least 24 hours before your scheduled billing date. If you attempt to cancel within 24 hours of your renewal date, you won’t be able to do so through your account section, and the cancellation will apply to the subsequent month or may incur cancellation fees. There are no cancellation fees when providing the required 24-hour notice before your renewal.

In the event that you need to cancel your 3-month or 6-month subscription before the minimum contract term is completed, please notify us with at least 24 hours’ notice before your next renewal date. Such cancellations will incur fees, including the price difference for any exclusive offer discounts you received on your initial order. It’s worth noting that you can also cancel your 3-month or 6-month subscription free of charge once you have received all the boxes included in your contract.

We aim to accommodate your requests, but please be aware that cancellations within the contract period will be assessed on a case-by-case basis, depending on the status of your order within our packing system. We regret to inform you that if your order has already been packed or shipped, we are unable to recall the parcels and, as a result, cannot cancel these orders.

SOCIAL MEDIA COMPETITIONS AND GIVEAWAYS

Forelock & Fringe’s social media competitions and giveaways are open to individuals aged 18 years or older, residing in countries where we offer delivery. There is no entry fee and no purchase necessary to enter. By participating, entrants agree to these terms and conditions. The closing date for entries will be specified on the relevant competition post, and entries submitted after this date will not be accepted. We cannot be held responsible for entries not received, regardless of the reason. For competitions involving a partner, entrants must review and agree to the partner’s terms and conditions, as Forelock & Fringe cannot be held responsible for external parties. Prizes cannot be exchanged for cash alternatives, and monthly recurring competitions will only award a single winner’s prize. Winners will be selected randomly and announced on Forelock & Fringe or partners social media accounts, with the winning entrant contacted directly. Winners may be asked for permission to use prize imagery on social media. The prize cannot be combined with any other offer, and multiple entries are allowed. We do not condone bullying, trolling, or ‘doxing’; participants engaging in such activities may be disqualified or banned from future competitions. This includes online harassment or negative commentary on social media. All participants must remain respectful at all times, as determined by the Forelock & Fringe Marketing Team. Participation in these competitions constitutes full and unconditional agreement to these terms and conditions.

PROMOTIONS, FREE GIFTS AND SALES

Forelock & Fringe’s promotions, offers, and sales are subject to the following terms and conditions. All promotions and offers are valid only on our website unless otherwise stated and are subject to stock availability. Promotions, free gifts and discounts do not apply to sale items or one off box purchases and may be withdrawn at any time at our discretion. Items added to an order as part of a promotion are discounted to no value and can not be exchanged or returned. Promotional items must be added or requested at the time of purchase or when adding qualifying items to the basket. If free gifts are included as part of the promotion, it must be requested at the time of purchase or when adding qualifying items to the basket. No alternative can be provided, and the value of the item is at our discretion. Qualifying items for promotions are subject to stock availability. If a promotional discount or offer is missed at the time of purchase, we cannot apply the discount or offer at a later stage nor can we send any missing items separately at a later time.

Sales apply during the stated period, with the start date announced on forelockandfringe.co.uk via sign-up, notification, email, or otherwise. Sale dates will be provided as accurately as possible, but Forelock & Fringe reserves the right to adjust the sale period without notice. Additional discounts cannot be used on sale items unless explicitly stated. We reserve the right to apply additional discounts to items during a sale. If a product is bought outside the sale period, Forelock & Fringe will not honour any difference in the sale price. Subsequent price differences after a purchase made during a sale period are not eligible to be claimed. Participation in our promotions, offers, and sales constitutes full and unconditional agreement to these terms and conditions.

MYSTERY ITEMS AND BOXES

Mystery boxes and mystery items include products from any past collections, such as Christmas, Spring, Summer, Competition, Gift Boxes, Monthly Subscription Boxes, or our Advent Calendar. These offers help us make room for new stock arriving. You may receive duplicates if you have purchased any of these products before, and they cannot be exchanged for different sizes or colours. Clothing items are sized according to different brands and labelled as XXS, XS, S, M, L, XL, XXL, XXXL, Pony, Cob, and Full, but fit may vary. All mystery items are pre-selected, and sizes cannot be adjusted. Items are selected randomly from various ranges, and we cannot cater to dietary requirements. Some food items may have short expiry dates. If you order more than 1 item of the same product we cannot guarantee that you won’t receive the same item twice; this is all subject to availability.  

The total Recommended Retail Price (RRP) of the mystery items will be higher than the price you pay. Mystery items are non-returnable and non-refundable. Unlike our carefully curated monthly subscription boxes, mystery boxes are compiled from previous collections without the same level of curation. They are limited edition and will not be restocked once sold out. Colours and items are random, and preferences cannot be given. We cannot check if you have already received specific items. Ordering multiple mystery items may result in duplicates. Items may also be out of season, and all sales are final.

ADVENT CALENDAR

The Forelock & Fringe Advent Calendar, is strictly non-refundable and non-returnable. Unfortunately, we are unable to accommodate food allergies or intolerances. Please note that the Advent Calendar is a distinct purchase and is not associated with your subscription box; thus, any preferences specified for subscription boxes will not be considered for this order. This product is available exclusively through pre-order, with shipping commencing in batches throughout November 2024, and delivery guaranteed before December.

Owing to the high demand for this item, we cannot alter sizes or apply any special discounts once the order has been placed. Should you order multiple Advent Calendars, each will incur separate shipping charges, and they will be dispatched individually, potentially arriving at different times. Please be advised that we cannot facilitate exchanges for any items featured in this year’s Advent Calendar due to sizing or colour preferences. Images are for illustration purposes only and pricing correct at the time of listing. It is imperative to consult the sizing guide prior to making your purchase. 

In the event that any items within your Advent Calendar arrive damaged or faulty, please refer to our Faulty Goods Policy for guidance on how to proceed. This policy outlines the steps for reporting and returning damaged items and ensures that your concerns are addressed promptly and efficiently.

USER CONTENT RIGHTS

By tagging Forelock & Fringe and sharing photos of unboxing our subscription boxes or using our items across any social media channels, including but not limited to Instagram, TikTok, Facebook, and Facebook groups, you grant Forelock & Fringe permission to use these photos across our social media channels, website, and monthly newsletter. By participating in these activities, you acknowledge and agree that Forelock & Fringe may use your content for promotional and marketing purposes without any compensation. This agreement is binding and applicable to all user-generated content shared with or tagged to Forelock & Fringe.

REFER A FRIEND

Forelock & Fringe’s Refer a Friend offer allows both the referee and the referral to receive 50% off their subscription box. This discount is only valid on monthly, bi-monthly, or 6-month recurring subscriptions and is not applicable to one-off purchases. Existing customers who refer a friend will receive a 50% off subscription box coupon (valid on recurring subscription plan only and will not apply to items from ‘Members shop’) once the friend’s order has been completed, i.e., after shipping. If this order is refunded or returned, the referee also forfeits the 50% off coupon. The Refer a Friend offer is valid only for new subscribers, defined as those who have never previously placed an order with Forelock & Fringe. Any unauthorised use of these discount codes may result in order cancellation and, for repeat offences, cessation of trading or supply of goods with the offending individual and all their known aliases. If the name on the purchase or the user’s IP address is flagged as fraudulent and the name connected to the order does not match the name associated with the email, our Customer Service team retains the right to decline providing the discount code. If someone is found to be using fake aliases, it will result in the cancellation of both the new purchase and the referee’s order. This Scheme cannot be used in conjunction with any other offer. Participation in the Refer a Friend offer constitutes full and unconditional agreement to these terms and conditions.

MEMBERS SHOP

As a member, you may add items to your next subscription box, with stock held for you until your subsequent payment date. In the event that any items are out of stock at the time of packing, Forelock & Fringe will issue a refund for those items and will notify you accordingly. To ensure inclusion in your upcoming box, items must be added and paid for before your renewal date; otherwise, they will be included in the following month’s box.

Members are entitled to a 15% discount off the RRP on all shop items and will not incur additional shipping fees for added items. However, should items be excessively large or heavy, they may be shipped separately in different boxes, and, in some cases, your subscription box may also be divided into multiple shipments. In the event of a failure of your renewal order, any added items may no longer be held. Cancelling your subscription will result in the removal of any added items from your box. Participation in the members shop constitutes full and unconditional agreement to these terms and conditions.

PRICING/ERRORS

Product prices and product availability are subject to change without notice. We may cancel any offer and reserve the right to correct errors, including after an order has been submitted, whether or not your credit/debit card has been charged. If your credit/debit card has already been charged and your order is cancelled, the Company will issue a refund to your credit/debit card account in the amount of the charge. You accept that your subscription being ‘auto renewed’ on the date advised at sign up is not considered an error liable for refund.

ORDER ACCEPTANCE/CONFIRMATION

We reserve the right at any time after receipt of your order to accept or decline your order. The Company reserves the right to decline sales to any party.

WARRANTY

You are responsible for deciding if the products you receive are suitable for yourself and your horse (including allergies, choking, and all other hazards). You agree that the sole solution for any damage arising from using our products will be credited towards your next subscription as decided by Forelock and Fringe. We will not offer any compensation under any circumstance.

SITE AND CONTENTS OWNERSHIP

The Site is owned by Forelock and Fringe Ltd. All of the content displayed on the Site, including, but not limited to, text, graphics, data, photographic images, moving images, sound, illustrations, software and the selection and arrangement thereof (“Forelock and Fringe Ltd “) its licensors or its third-party image partners. All elements of the Site, are protected by copyright, trade dress, moral rights, trademark and other laws relating to the protection of intellectual property.

USE OF THE SITE

All content is intended for customers of Forelock and Fringe. You may not use the Site or for any purpose not related to your business with Forelock and Fringe Ltd. You are prohibited from: (a) copying or re-transmitting any or all of the Site or content without a written agreement from Forelock and Fringe; (b) using any data mining, robots or similar data gathering or extraction methods; (c) registering, subscribing, unsubscribing or attempting to register, subscribe or unsubscribe any party for any Forelock and Fringe Ltd. Product or service if you are not authorized to do so; (d) modifying any part of the Site or Forelock and Fringe LTD. (e) disabling or interfering with security-related features of the Site or any system resources, services or networks connected to or accessible through the Site; (f) selling, licensing or leasing any content without specific written authorisation from Forelock and Fringe Ltd; and (g) using the Site other than for its intended purpose. (h) Additionally, you agree not to use the Site or contents in any manner that could damage the reputation of the company.

TRADEMARKS

All logos, designs and trademark and any other product or service name or slogan contained in the Site are trademarks of Forelock and Fringe and its suppliers or licensers, and may not be copied, imitated or used, in whole or in part, without the prior written permission of the company or the applicable trademark holder. In addition, the design of the Site, including all page headers, custom graphics, button icons and scripts, may not be copied, without written permission.

Your participation, correspondence or business dealings with any third party found on or through the Site, regarding the payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such third party. You agree that Forelock and Fringe shall not be responsible or liable for any loss, damage or other matters of any sort incurred as the result of any such dealings.

INTERACTIVE SERVICES OR AREAS

By using any Interactive Areas, you agree not to upload or create or otherwise publish through the Site any of the following: a. Any data, information, text, music, sound, comment, photos, graphics, code or other material (“User Content”) that is defamatory, obscene, pornographic, harmful to minors, indecent, lewd, unlawful, invasive of privacy or publicity rights or abusive; b. Viruses, corrupted data or other harmful, disruptive or destructive files; and c. Unsolicited promotions, political campaigning, advertising, junk mail, spam, chain letters, pyramid schemes or solicitations;

REGISTRATION DATA AND ACCOUNT SECURITY

By using the Site or subscribing to Forelock and Fringe Ltd you agree to: (a) provide accurate information about you on the Site (“Registration Data”); (b) maintain and promptly update the Registration Data, and any other information you provide to Company; (c) maintain the security of your password; (d) notify us immediately of any breach of security connected with your account; (e) accept all responsibility for any and all activities that occur under your account; and (f) accept all risks of unauthorised access to the data and any other information you provide.

INDEMNIFICATION

You agree to defend, Forelock and Fringe, its affiliates, licensers, subsidiaries, independent contractors, investors, employees, agents, third party information providers and against any claims, damages, costs, liabilities and expenses (including, but not limited to, reasonable attorneys’ fees) issues arising out of or related to anything connected to the contents of your Forelock and Fringe.

You also agree to defend, indemnify and hold harmless Forelock and Fringe Ltd, its affiliates, licensers, subsidiaries, independent contractors, investors, employees, agents, third party information providers and against any claims, damages, costs, liabilities and expenses (including, but not limited to, reasonable attorneys’ fees) arising out of or related to anything related to User Content that you post, store or otherwise transmit on or through the Site, your conduct, your use or inability to use the Site, your breach or alleged breach of the Site Terms or of any representation or warranty contained herein, your unauthorised use of the Forelock and Fringe Ltd. Content, or your violation of any rights of another.

DISCLAIMER

Forelock and Fringe Ltd will not be liable for any damages of any kind arising from contents contained within your Forelock and Fringe Ltd (including but not limited to, personal injury, pain and suffering, emotional distress, choking, medical complaints, death or injury to any animal or person). Children, animals and horses must be monitored at all times when using our items and should always be supervised. Our treats and toys are only intended for the animal size for which the product is subscribed for. Our products aren’t suitable for humans, including children, other animals and other horses. You accept responsibility to keep the contents away from all of the above.

You, not Forelock and Fringe Ltd, assume the entire cost of all necessary veterinary bills, medical bills, or any arising legal fees or bills whatsoever due to your subscription to Forelock and Fringe Ltd. And our services including our products and Forelock and Fringe Ltd.

Forelock and Fringe Ltd will not be liable for any damages of any kind arising from the use of the site or content, including, but not limited to lost profits, and direct, indirect, incidental, punitive and consequential damages. We make no warranty that the site is free from infection by viruses or anything else that has contaminating or destructive properties.

LIMITATION OF LIABILITY

In no event shall Forelock and Fringe Ltd., its directors, investors, employees or agents be liable for any direct, indirect or consequential damages, or any other damages of any kind, including but not limited to death, illness, medical complaints, loss of profits or loss of data, whether in an action in contract, tort (including but not limited to negligence) or otherwise, arising out of or in any way connected with the use of the site, our products, the services, Forelock and Fringe Ltd. Content or the materials contained in or accessed through the site, including without limitation any damages caused by mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, whether or not resulting from acts of god, communications failure, theft, destruction or unauthorised access to Forelock and Fringe Ltd records, programmes or services. You agree total cumulative liability shall not exceed the amount paid to Forelock and Fringe Ltd. for that calendar month in question. British law shall apply to these Terms, and the parties agree to submit all disputes between them to the exclusive jurisdiction of the British courts.

TERMINATION

Forelock and Fringe Ltd reserve the right, without notice and in its sole discretion, to terminate your account/subscription and/or to block your use of the Site.
